Start with the DSO—not Form I-765
For OPT, the student first asks the designated school official to review the request. The DSO enters an OPT recommendation in SEVIS and issues an updated, signed Form I-20. Filing Form I-765 before that recommendation, or using a recommendation that has become too old, can lead to denial.
Study in the States instructs students to file Form I-765 within 30 days after the DSO enters the OPT recommendation. Treat the SEVIS recommendation date as a controlled deadline: obtain the new Form I-20, check its information immediately and do not let a draft application sit until the 30-day period expires.
Map all of the dates before submitting
For post-completion OPT, the current agency timeline says Form I-765 may generally be filed as early as 90 days before the program end date and no later than 60 days after it, while still meeting the 30-day DSO-recommendation rule. The intersection of those windows matters more than any single date by itself.
Do not choose a filing date only because it is convenient. A transfer, earlier CPT, a terminated SEVIS record, a fixed admission period or another status event can change the analysis. The DSO handles the school record; a licensed immigration attorney should address legal status questions the DSO cannot decide.
| Date | Why it matters | Where to verify it |
|---|---|---|
| Program end date | Helps define the post-completion filing window | Current Form I-20 |
| DSO recommendation date | Starts the 30-day Form I-765 clock | OPT-endorsed Form I-20 and DSO record |
| Form I-765 submission date | Must fit every applicable filing window | USCIS online receipt or delivery evidence |
| Admit-until date | May create a separate extension-of-stay issue | Most recent Form I-94 |
| EAD start date | Work cannot begin before this date and approval | Physical EAD and USCIS decision |
Use the edition USCIS actually accepts
USCIS currently says it continues to accept the 08/21/25 edition of Form I-765 and is not accepting the 09/15/26 edition because of a September 14, 2026 court order. That litigation alert overrides the natural assumption that the form with the newer date must be used. Recheck the Form I-765 page on the day of filing because the order or acceptance rule can change.
Eligible F-1 students may file Form I-765 online or follow the paper instructions. Use the USCIS Fee Calculator for the exact category and filing method on the submission date. The separate $70,000 and $30,000 OPT charges published October 8 are only proposed and should not be added to a current filing.
A fixed admission date can add another filing question
The 2026 fixed-period admission rule means some students may need an extension of stay when OPT would continue beyond the admit-until date on Form I-94. The D/S transition rules are different: the official FAQ says certain students admitted for duration of status who timely file post-completion OPT or STEM OPT on or before six months after the September 15 effective date do not need a separate extension application under that transition provision.
Do not assume that every student needs Form I-539, or that nobody does. Compare the actual Form I-94, Form I-20, transition status, travel history and intended OPT period. A newly issued I-20 does not itself extend a date-certain admission period.
STEM OPT adds Form I-983 and employer duties
A student seeking the 24-month STEM OPT extension normally completes Form I-983 with a qualifying employer and provides it to the DSO before the new recommendation. The employer, degree, E-Verify participation, training plan and reporting duties are part of this process; a job title alone does not establish eligibility.
The October 8 proposed rule describes an automatic extension of up to 180 days when a STEM OPT Form I-765 is timely and properly filed before the current EAD expires, ending earlier if USCIS decides the application. This protection is specific and should not be generalized to a late filing or a different EAD category.
File, save and wait for authorization
This guide was checked against official sources on October 10, 2026. It explains a process but does not decide whether a student qualifies for OPT, STEM OPT, an extension of stay or employment authorization.
- Save the signed OPT Form I-20, the full Form I-765 submission, uploaded evidence, payment receipt and filing confirmation.
- Confirm that USCIS received the case within the 30-day DSO-recommendation period.
- Read every notice and compare any requested correction with the copy actually filed.
- Do not begin OPT employment while Form I-765 is merely pending; wait for approval, the EAD and its valid start date.
- Report required employment, address and other changes through the proper DSO, SEVIS or USCIS channel.
- Obtain legal advice promptly when a deadline, travel plan, status lapse or denial risk is present.
