Turning 21 does not produce one universal answer
U.S. immigration law generally defines a child as unmarried and under 21. A beneficiary who reaches 21 while a case is pending may “age out” of a child classification. The Child Status Protection Act can preserve child classification in specified situations, but it does not freeze every beneficiary’s age on the petition date.
First identify the immigration category and the procedural path. An immediate relative of a U.S. citizen, a family- or employment-preference derivative, a diversity-visa derivative, and a derivative refugee or asylee do not all use the same CSPA rule. A correct calculation from the wrong category is still the wrong answer.
Some preference cases use a subtraction formula
For covered family- and employment-preference adjustment cases, USCIS generally describes the calculation as the beneficiary’s age when an immigrant visa becomes available minus the time the qualifying petition was pending. The result is the CSPA age; it is not simply the age printed on the passport or the age when the petition was filed.
USCIS policy applies the Final Action Dates chart to determine visa availability for CSPA calculations for adjustment requests filed on or after August 15, 2025. Do not substitute the Dates for Filing chart merely because it allowed earlier document submission. Record the applicable policy date, chart, category, chargeability column, priority date, petition filing date and petition approval date.
The one-year step can matter as much as the arithmetic
Many preference applicants also must seek to acquire lawful permanent resident status within one year after a visa becomes available. USCIS policy identifies qualifying actions and addresses extraordinary-circumstances arguments, but this is not a casual “I intended to file” test. Preserve the actual filing, fee, application or other official record that counsel says satisfies the rule.
A visa can become unavailable again before a continuous year passes, and USCIS policy addresses recalculation when availability returns. That is why families should keep every monthly Visa Bulletin and filing record used in the analysis. Do not wait for a birthday before asking for legal review.
Immediate relatives and humanitarian categories have different protections
For certain immediate relatives, CSPA can fix age based on the date the qualifying petition was filed, subject to the applicable statutory conditions. Derivative asylee and refugee rules use their own reference events. Diversity Visa cases use a separate calculation and remain bounded by the program year.
Marriage can also change eligibility because the statutory definition of child includes being unmarried. The effect of a parent’s naturalization, a change in marital status or a conversion between preference categories needs category-specific analysis. Do not assume CSPA protects the category while ignoring the relationship requirements.
Build a CSPA review sheet before asking for advice
| Record | Why it matters |
|---|---|
| Birth record | Establishes the actual date of birth. |
| Petition receipt and approval | Shows filing, approval and possible pending time. |
| Priority date and category | Connects the case to the correct Visa Bulletin row. |
| Monthly Visa Bulletin | Documents the asserted visa-availability date. |
| Filing or payment proof | May document the one-year sought-to-acquire step. |
| Marriage and status history | Can affect whether the qualifying child relationship continued. |
Do not rely on an online calculator alone
A calculator can subtract dates but cannot safely choose the legal category, resolve petition amendments, decide when a visa became available, assess extraordinary circumstances or determine whether a qualifying action occurred. Preserve the source documents and let a licensed immigration attorney review any age-out risk promptly.
This guide does not extend the one-year period, reserve a visa number or determine that a beneficiary remains a child. It was checked October 21, 2026 against the current USCIS CSPA page, Policy Manual and Department of State Visa Bulletin hub. No new CSPA policy was announced today; this is an evergreen process guide.
